Communities in Donetsk, Luhansk, Zaporizhzhia, and Kherson Oblasts have appealed to the President of Ukraine, Volodymyr Zelenskyy, requesting the immediate signing of the Law of Ukraine "On Amendments to the 'Final and Transitional Provisions' of the Civil Code of Ukraine Regarding the Peculiarities of Lending and Financial Leasing During Martial Law" (№ 4340-IХ)
This document introduces a moratorium on any forced debt collection during martial law and for one year after its cancellation. It could become the only protection for hundreds of entrepreneurs whose production facilities have been virtually destroyed or ended up under occupation due to hostilities.
"As a result of hostilities on the territory of Ukraine, a huge number of entrepreneurs have lost the opportunity to conduct normal economic activities. The occupation of Ukrainian territories by the enemy, the destruction or seizure of assets used as collateral, the loss of means of production and labor collectives - this is far from an exhaustive list of problems faced by farmers after February 24, 2022," the appeal emphasizes.
The authors add that "constant attempts by commercial banks to recover debts from those who have already suffered and lost everything they created throughout their lives undermine the morale of people" and actually leave families without funds and shelter, even when debtors have no real opportunity to pay.
"In these circumstances, citizens from temporarily occupied territories are particularly in dire need of justice and protection of the state, but they do not receive it. It is unfair that people who consciously chose Ukraine - left their homes and businesses - are instead being persecuted by banks. And, relying on courts and the enforcement service, financial institutions are forcing them to give away the last thing that the enemy did not manage to steal," representatives of the communities point out.
As emphasized in the appeal, without the urgent signing of the law, people are forced to return to the occupied territories, which undermines the state's efforts to protect its people and poses a threat to national security.
The communities call on the President to immediately sign this law, as it is "only the first, but absolutely necessary step to protect those who remained loyal to Ukraine in very difficult circumstances" and gives business a chance to recover in the controlled territory and subsequently fulfill their obligations to creditors and lessors.
The Association of Milk Producers supports this appeal, because it is the moratorium that will allow farmers whose fields and property ended up in the war zone or under occupation to save their businesses and jobs and resume operations in the controlled territories. AMP has already appealed to the President with a similar call, emphasizing the need for the urgent signing of the law to protect hundreds of affected farms and stabilize the country's food security.
